What can I claim secondary to malignant neoplasm of the lung?

1 condition in the Repatriation Medical Authority's Statements of Principles list malignant neoplasm of the lung as a factor. If DVA has accepted your malignant neoplasm of the lung, each of these has a documented pathway to a further claim.

How a secondary claim works

Some Statement of Principles factors are not about service at all — they name another condition. Where DVA has already accepted your malignant neoplasm of the lung, and another condition's SoP lists malignant neoplasm of the lung as a factor, that part of the next claim is already established on your file. Conditions that list malignant neoplasm of the lung as a factor

Quoted from the instrument. A pathway existing is not the same as a claim succeeding — each factor carries thresholds your record has to satisfy.

Bronchiolitis obliterans organising pneumonia

RH No. 79 of 2018 · BoP No. 80 of 2018

Reasonable Hypothesis — factor (4): “undergoing a course of therapeutic radiation for the treatment of malignant neoplasm of the breast or malignant neoplasm of the lung within the two years before the clinical onset of bronchiolitis obliterans organising pneumonia” [clinical onset] — factor (12): “undergoing a course of therapeutic radiation for the treatment of malignant neoplasm of the breast or malignant neoplasm of the lung within the two years before the clinical worsening of bronchiolitis obliterans organising pneumonia” [worsening]

This factor appears in the Reasonable Hypothesis instrument only, which applies to operational service.

What DVA means by malignant neoplasm of the lung

A claim is tested against the definition first. If the diagnosis on your file does not meet this wording, the factors below never get reached — so it is worth checking that what your doctor wrote matches what the instrument requires.

Malignant neoplasm of the lung, for the purposes of the Statement of Principles, for the purposes of this Statement of Principles, malignant neoplasm of the lung: (a) means a primary malignant neoplasm arising from the epithelial cells of the trachea, bronchus, bronchioles or alveoli; and (b) includes: (i) adenocarcinoma of the lung; (ii) carcinoma in situ of the lung; (iii) large cell carcinoma of the lung; (iv) lymphoepithelial carcinoma of the lung; (v) non-small cell carcinoma of the lung; (vi) small cell carcinoma of the lung; and (vii) squamous cell carcinoma of the lung; and (c) excludes: (i) carcinoid tumours; (ii) haematolymphoid tumours including non-Hodgkin lymphoma and Hodgkin lymphoma; (iii) malignant melanoma; (iv) mesenchymal tumours including soft tissue sarcoma; (v) mesothelioma; and (vi) metastatic cancer from other primary sites. (3) While malignant neoplasm of the lung attracts ICD-10-AM codes C33, C34, D02.1 and D02.2, in applying this Statement of Principles the meaning of malignant neoplasm of the lung is that given in subsection (2). (4) For subsection (3), a reference to an ICD-10-AM code is a reference to the code assigned to a particular kind of injury or disease in The International Statistical Classification of Diseases and Related

Aggravation-only factors. In this instrument, subsections 9(37) apply only to material contribution to, or aggravation of, malignant neoplasm of the lung where it was already present before or during service. If service caused malignant neoplasm of the lung outright, those factors are not available to you.

What could support a claim for malignant neoplasm of the lung?

The Statement of Principles for malignant neoplasm of the lung names 1 other condition among its own factors. If any of these is already accepted on your file, it may be the factor that carries a malignant neoplasm of the lung claim — quoted here from the instrument.

Systemic sclerosis

Reasonable Hypothesis — factor (29): “having systemic sclerosis at least 3 years before the clinical onset of malignant neoplasm of the lung” [clinical onset]

Balance of Probabilities — factor (23): “having systemic sclerosis at least 3 years before the clinical onset of malignant neoplasm of the lung” [clinical onset]
