Invalidity Pensions, Tax and DVA Offsetting: The Money Questions Before You Apply

A successful CSC claim can change your income for decades, but it also interacts with tax, DVA payments and insurance. CSC itself recommends getting financial advice before a retrospective application. Here's what to understand first.

How much does a CSC invalidity pension pay?

  • MilitarySuper Class A – an indexed pension as if you'd served to compulsory retiring age (around $60,000 a year gross in one CSC example).
  • Class B – the greater of half Class A or your actual-service pension.
  • Class C – no pension; benefit preserved.

MilitarySuper invalidity pensions are CPI-indexed and not reduced by other income. ADF Cover and DFRDB use different formulas – see Class A, B and C explained.

Tax: the Douglas decision

In Commissioner of Taxation v Douglas (2020), the Full Federal Court held that DFRDB and MSBS invalidity pensions starting on or after 20 September 2007 are taxed as super lump sums, generally meaning less tax. Parliament preserved this outcome for those schemes and introduced a veterans' invalidity pension tax offset. It does not cover ADF Cover. A backdated pension may mean amending earlier tax returns.

DVA offsetting

  • MRCA/DRCA incapacity payments are reduced dollar for dollar by the Commonwealth-funded part of your CSC pension.
  • MRCA Special Rate Disability Pension is reduced by 60 cents per dollar of that part.
  • Your own contributions aren't counted.

Retrospective arrears and DVA debts

If you're approved retrospectively and received DVA incapacity payments for the same period, DVA commonly recovers the overpayment from your CSC arrears – and may seek any shortfall from you. For some veterans the net gain may be modest. Get the numbers modelled before lodging.

Insurance: lifePLUS Protect

If you had lifePLUS Protect auto cover after separation, retrospective approval as Class A or B can cancel that cover, with premiums refunded to your ADF Super account.

DVA changes from 1 July 2026

New claims are assessed under the MRCA, DRCA incapacity recipients moved to the MRCA, VEA-only veterans can claim MRCA incapacity payments, and some offsetting rules changed. These can alter how a CSC pension nets out.

Frequently asked questions

Is my CSC invalidity pension taxed?

Yes, but DFRDB and MSBS pensions starting from 20 September 2007 receive more favourable treatment after the Douglas decision.

Will a CSC pension reduce my DVA payments?

It can reduce MRCA/DRCA incapacity payments and the SRDP.

Can DVA take money from my CSC arrears?

Yes – recovery of overpayments from arrears is common.
